Terms of Service

1. What emkit Is
emkit is an engineering management toolkit ("Service") operated by Philip Tompkins ("we," "us," "emkit"). It helps engineering managers track 1:1s, performance reviews, team health, incidents, sprints, and more — all in one place.
2. Your Account
You're responsible for keeping your login credentials secure. Everything that happens under your account is your responsibility. If you suspect unauthorized access, let us know immediately at support@emkit.dev.
You must be at least 18 years old and provide accurate information when signing up.
3. Payment & Billing
emkit costs $80 per year, billed annually. Early adopters who sign up during OG pricing keep that rate for life. Prices may increase for new signups after the first 1,000 users.
Payments are processed through Stripe. You can cancel anytime from your account settings. Refunds are handled on a case-by-case basis — if you're unhappy, reach out and we'll make it right.
4. Your Data, Your Property
You own your data. Your management notes, team information, review content, and everything else you put into emkit belongs to you. We don't claim ownership of any of it.
You grant us a limited license to host, store, and display your data solely to provide the Service. If you delete your account, we delete your data.
5. Acceptable Use
Don't use emkit to do anything illegal, abusive, or harmful. Don't try to reverse engineer, scrape, or attack the Service. Don't share your account with others or resell access.
6. Termination
You can cancel your subscription and delete your account at any time. We may also terminate or suspend your account if you violate these terms. If we shut down the Service entirely, we'll give you reasonable notice and the ability to export your data.
7. Limitation of Liability
emkit is provided "as is." We do our best to keep things running smoothly, but we can't guarantee 100% uptime or that the Service will be error-free. To the maximum extent permitted by law, emkit's total liability is limited to the amount you've paid us in the 12 months before any claim.
We're not liable for indirect, incidental, or consequential damages — including lost profits, lost data, or business interruption.
8. Changes to These Terms
We may update these terms from time to time. If we make significant changes, we'll notify you via email or an in-app notice. Continued use of the Service after changes means you accept the updated terms.
9. Governing Law
These terms are governed by the laws of the State of Maryland, United States. Any disputes will be resolved in the courts of Maryland.
